For couples who wish to separate amicably, and fairly resolve their financial arrangements, this service could be for you. 

 

 

 

 

Unique to SE-Solicitors, Separate Together allows couples to use one legal team consisting of a skilled Lawyer Mediator and a highly experienced Barrister.

Separate Together can help reduce fees, and reduce issues associated with traditional proceedings. The service empowers a separating couple with the information and support to enable them to reach an agreement in relation to their property, family finances and, if relevant, any children of the family.

Monicka Rai, our empathetic Lawyer Mediator will work with you and your former partner both separately and together to assist you both in gathering the necessary financial information before meeting with our Consultant Barrister, Michael George. Michael George, a personable Consultant Barrister with 30 years’ legal experience is able to provide a sharp focus evaluation and a neutral preliminary view of the likely outcome in court. Together, our experienced legal team empowers a separating couple to reach an agreement amicably.

Is Separate Together right for us?

Both be ready to work amicably together to resolve issues.

Both be open to co-operation and full communication, willing to provide and exchange full financial disclosure.

There must be no power imbalance and no history or risk of abuse within the relationship.

Both be emotionally ready to work together, with little risk of conflict and without high levels of emotion.

Both have the capacity and ability to freely take part, without risk of harm of adverse consequences.

You must not have been placed under any pressure or duress to take part.

How does Separate Together work?

Initial Contact

You will each have an informal chat on the phone with a member of our team to discuss the Separate Together process and costs.

Agreements &
Questionnaires

If you decide to go ahead, you will each be sent the necessary documentation to proceed.

Individual Meetings

You will have an individual meeting to discuss your situation and determine whether Separate Together is the right process for you.

Joint Meeting

If you proceed, you will have a joint meeting to discuss your aims and any important issues. You will then gather relevant information.

Secondary Meeting

You will both present your financial information ahead of the meeting. At the meeting, your information will be reviewed to determine whether it is complete, or if more is required ahead of your Settlement Meeting.

Settlement Meeting

You will both meet with our Consultant Barrister, who will be provided with a summary of key issues and any relevant documents. Our Consultant Barrister will then help you reach an agreement, providing information on how a Court might handle your situation.

Settlement

If an agreement is reached at the Settlement Meeting, a independent Barrister from 3PB will prepare the documentation, setting out that agreement.

Outcome Document

The final part of the process needs to be carried out by an independent Barrister.

For ease, we will seamlessly bring in another Barrister from 3PB who will draft the Separation Agreement.

Any costs incurred outside the Separate Together process will be quoted for separately.

What is the difference between mediation and Separate Together?
With Separate Together, you will have the input from our Consultant Barrister, who will provide an evaluation of how a Judge might handle your situation if your matter were to be in court proceedings. This will allow you and your former partner to be fully informed of the likely outcome if you were to pursue the matter through the traditional court process. An independent Barrister is then able to prepare the Separation Agreement.

With mediation, the mediator acts as a neutral, impartial third party and provides legal information to allow you and your former partner to make the decisions. The mediator cannot provide advice. If an outcome is reached, you will then need to take the outcome documents to a solicitor to be placed into a legally binding document.

What is an early neutral evaluation?
An early neutral evaluation is when a third party provides an impartial assessment of your matter. At SE Solicitors, our Consultant Barrister can provide this evaluation to allow you, and your former partner, to understand what a Judge would be likely to do if your matter were in court proceedings. The evaluation provides an insight into the likely outcome in a court process without having to make an application to the court.
What happens if we don’t reach an outcome?
If you do not reach an outcome, it is recommended that you obtain independent legal advice from a solicitor.
Do we receive advice?
No advice is given within the Separate Together process; you will receive guidance, legal information, and an evaluation of your matter. If you require advice alongside the Separate Together process, you will need to instruct your own independent Solicitor.
What are the advantages of avoiding court?
Reduced fees, control over the process, speed, reduced conflict, and the advantage of additional expertise and support at the right junctures
What relevant information do I need to gather for the meetings?
You will be sent a preliminary information form to complete at the outset of the process, and our Separate Together expert will run through the information that you will need to gather at your first joint meeting.
What can be covered in the Separate Together settlement?
Separate Together can assist couples to reach an agreement in relation to their property, family finances and, if relevant, arrangements for any children of the family.
