What is family mediation?
Family mediation is a process where a neutral third party, the mediator, helps family members to consider options after separation, such as arrangements for children or how to separate their family finances. It’s a collaborative approach focused on finding mutually acceptable solutions.
When is family mediation used?
Family mediation is used primarily after a relationship breaks down, to consider options relating to children, property, and finances. It is a preferred method when individuals want to consider amicable resolutions without going to court.
How long does family mediation typically take?
The duration varies depending on the complexity of the issues and the willingness of the participants to engage in the process. Typically, it can take anywhere from three to six sessions over several months.
Is the outcome of family mediation legally binding
The outcomes reached in family mediation are not automatically legally binding. However, they can be made legally binding through a ‘consent order’ if both participants wish to move forward with matters in this way.
Why should I consider family mediation
As mediation is a voluntary process, it allows the participants to move at their own pace and remain in control of the decisions being made. Mediation is often less stressful and a more time effective route than going to court. It can also be more cost effective, as both participants are able to share the hourly rate for the mediator, however if both individuals appoint independent legal advice, each individual will incur the hourly rate of their appointed legal representative.
