Almost half of the professional practitioners recently surveyed by STEP have said that they have noticed an increase in disputes within blended families.  

Blended families are increasingly common, bringing together children from previous relationships, stepchildren, half-siblings, shared assets and so on, which can create complexities in relation to inheritance and estate planning.

A properly prepared Will is essential for protecting everyone involved and for ensuring assets are distributed in accordance with personal wishes. Without one, intestacy rules may distribute assets in ways that do not reflect a person’s wishes. For example, a surviving spouse could inherit most of an estate while children from an earlier relationship receive less than intended or nothing at all.

A carefully drafted Will helps reduce uncertainty by clearly stating who receives what and when. It can also appoint guardians for minor children and name executors to manage the estate.

Many couples also use trusts alongside Wills. Trusts can provide income for a surviving spouse during their lifetime while preserving assets for children from a previous relationship. This approach can balance the interests of all involved.

Regularly reviewing a Will helps ensure it still reflects family relationships and personal intentions, particularly as family circumstances change. Marriage, divorce, births and changes in financial circumstances can all affect how an estate should be managed.
