FAQs

Your questions answered. Take a look at some our frequently asked questions about Grandparents Rights.

Can I stop my grandchildren from moving away?
If the parent(s) have made the decision to move your grandchildren and you do not agree with it, you may be able to apply for a Prohibited Steps Order. You would first need to seek permission from the Court to make the application as grandparents do not have parental responsibility.
How can I see my grandchildren if their parents have split?
Start simple, talk to the parents. For communication to be effective, it is vital that the focus is on what is best for your grandchildren. If discussions do not go well, you may want to try other options such as mediation or a Court application.
What should I do if I have been denied access to my grandchild
Grandparents have no legal right to see their grandchildren. It is down to the parents as to who their children spend time with, how and when. If you are being denied access to your grandchild, then there are things you can do including mediation or applying for a Child Arrangements Order to see your grandchild.
If my child cannot see my grandchild, can I?
Yes, you can. Your relationship with your grandchild is separate to their relationship with their parent (your child). Sadly, it’s not always straightforward and each family situation is different.

Everyone’s focus should be on your grandchild’s needs. This is the starting point for all communication. If communication is difficult, you may want to try mediation. If mediation doesn’t work, you can apply to the Court for permission to seek a Child Arrangements Order.
